Purpose of Form 10F 

If your Tax Residency Certificate (TRC) does not have all the details needed under the DTAA, you will have to submit Form 10F to provide the missing information.

To get the benefits of a tax treaty, non-residents must give both their TRC and, if required, Form 10F as per Section 90(5) of the Income Tax Act. 

Your TRC should mention your name, foreign address, Tax Identification Number (TIN) and your tax status. If any of these details are missing, you will need to file Form 10F online to complete them.

By doing this, NRIs can claim tax reliefs, exemptions or deductions on income earned in India and help them avoid being taxed twice.

Who is Eligible to File Form 10F?

List of Documents Required to File Form 10F 

Before you file Form 10F online, make sure you have a few important documents and details ready. Here is what you will need:

  • Tax Residence Certificate (TRC)
  • PAN card
  • Period of residence, as stated in your TRC
  • Proof of residence in your country of residence
  • Tax Identification Number (TIN) or an equivalent number
  • Proof of nationality (for individuals)
  • Proof of registration or incorporation (for companies, firms or other entities)
  • Details of your taxpayer status (individual, trust, firm, company, etc.)

You must also electronically sign Form 10F using a Digital Signature Certificate (DSC).

Steps to Download and File Form 10F in India

You can download Form 10F from the official Income Tax website. Follow these steps to learn how to file Form 10F online:

  1. Log in to the Income Tax e-filing portal using your PAN or user ID (register if you do not have an account).
  2. Go to ‘e-File’ -> ‘Income Tax Forms’ -> ‘File Income Tax Forms’.
  3. Under the ‘Person not dependent on any source of income’ tab, find Form 10F and click ‘File Now’.
  4. Enter your PAN, select the assessment year, and fill in details like your name, country of residence, TIN and TRC period.
  5. Upload your Tax Residency Certificate (TRC), verify using a Digital Signature Certificate (DSC) or Electronic Verification Code (EVC), preview and submit.
